2. Pursuant to Article 37 of the GDPR, "DARGOM INFORMATYKA PRZEMYSŁOWA Dariusz Gomola" has not appointed a Data Protection Officer.

3. The Privacy Policy constitutes an integral part of the Terms and Conditions. By using the services offered by us, you entrust us with your information. This document is intended solely to help you understand what information and data are collected, for what purpose, and how they are used. This data is very important to us, therefore we ask you to read this document carefully, as it sets out the principles and methods of processing and protecting personal data. This document also sets out the rules for the use of “Cookies”.

We hereby inform you that we comply with the principles of personal data protection and all legal regulations provided for by the Personal Data Protection Act and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC.

5. At the request of a person whose personal data is processed, we provide comprehensive information on how we use their personal data. We always strive to clearly inform you about the data we collect, how we use it, the purposes for which it is used and to whom it is disclosed, what protection we provide when transferring such data to other entities, and we provide information about the institutions that should be contacted in case of any doubts.

6. The legal basis for processing your personal data is:

Article 6(1)(a) the data subject has given consent to the processing of their personal data for one or more specific purposes;

Article 6(1)(f) processing is necessary for the purposes of the legitimate interests pursued by the Controller or by a third party.

7. Your personal data related to the conclusion and performance of a contract will be processed for the duration of its performance and for a period no longer than permitted by law, including the provisions of the Civil Code and the Accounting Act, i.e. for no longer than 10 years from the end of the calendar year in which the last contract was performed.

8. Your personal data processed for the purpose of concluding and performing future contracts will be processed until you object to such processing.

9. You have the right to: access your personal data and receive a copy of the personal data being processed; rectify inaccurate personal data; request the erasure of data (the right to be forgotten) where the circumstances provided for in Article 17 of the GDPR occur; request restriction of processing in the cases indicated in Article 18 of the GDPR; object to the processing of data in the cases indicated in Article 21 of the GDPR; and receive the data you have provided, processed by automated means, in a portable format.

10. If you believe that your personal data is being processed unlawfully, you may lodge a complaint with the supervisory authority (Personal Data Protection Office, ul. Stawki 2, Warsaw). If you require additional information related to personal data protection or wish to exercise your rights, please contact us in writing at the correspondence address.

11. We comply with all applicable laws and regulations concerning data protection and will cooperate with data protection authorities and duly authorised law enforcement authorities. In the absence of specific data protection regulations, we will act in accordance with generally accepted principles of data protection, principles of social coexistence and established customs.

§ 3 Scope and Purpose of Personal Data Collection

1. We process the personal data necessary for the provision of services and for accounting purposes, and only for such purposes.

2. We collect, process and store the following User data:

• first and last name,

• e-mail address,

• telephone number (mobile or landline),

• information about the web browser used,

• other personal data voluntarily provided to us.

3. Providing the above data is entirely voluntary, but it is also necessary for the full provision of services.

4. We may transfer personal data to servers located outside your country of residence or to affiliated entities or third parties based in other countries, including countries within the EEA (European Economic Area – a free trade area and Single Market comprising the Member States of the European Union and the European Free Trade Association, EFTA), for the purpose of processing personal data by such entities on our behalf in accordance with the provisions of this Privacy Policy and applicable laws, customs and regulations concerning data protection.

§ 4 Cookies

1. We use cookies or similar technologies (hereinafter collectively referred to as “cookies”), which are understood as IT data, in particular text files, intended for use with the website and stored on the end devices of Users browsing the website. Information collected through cookies allows services and content to be adapted to individual needs and User preferences, and is also used to compile general statistics concerning Users' use of the website. Data collected through cookies is gathered solely for the purpose of performing specific functions for Users and is encrypted in a manner preventing unauthorised access.

First-party cookies - files placed on and read from the User's Device by the website's IT system;

Session cookies - files placed on and read from the User's Device by the website during a single session of the Device. After the session ends, the files are deleted from the User's Device;

Persistent cookies - files placed on and read from the User's Device by the website until they are manually deleted. The files are not automatically deleted after the Device session ends unless the User's Device is configured to delete cookies after the end of the Device session.

§ 5 Social Media Plug-ins

1. Social media plug-ins may be present on our website.

2. A plug-in provides its supplier only with information about which of our web pages you accessed and at what time. If, while viewing or browsing our website, the User is logged into an account on, for example, Facebook or Twitter, the supplier may associate your interests, information preferences and other data obtained, for example, by clicking the Like button, leaving a comment or entering a profile name in a search. Such information will also be transmitted directly by the browser to the supplier.

3. To prevent a visit from being recorded on a selected User account by a plug-in on our website, you must log out of your account before browsing our website.

§ 6 Rights and Obligations

1. We have the right, and in cases specified by law also a statutory obligation, to disclose selected or all information relating to personal data to public authorities or third parties that submit a request for such information on the basis of applicable Polish law.

2. The User has the right to:

1) access personal data: The User has the right to obtain access to their personal data, exercised upon a request submitted to the Controller;

2) rectify personal data: The User has the right to request that the Controller promptly rectify personal data that is inaccurate and/or complete incomplete personal data, exercised upon a request submitted to the Controller;

3) erase personal data: The User has the right to request that the Controller promptly erase personal data, exercised upon a request submitted to the Controller. In the case of User accounts, data erasure consists of anonymising data that enables the User to be identified. The Controller reserves the right to suspend the fulfilment of a data erasure request in order to protect the Controller's legitimate interests (e.g. where the User has breached the Terms and Conditions or the data was obtained as a result of correspondence). In the case of the Newsletter service, the User may independently delete their personal data using the link included in each e-mail sent;

4) restrict the processing of personal data: The User has the right to restrict the processing of personal data in the cases specified in Article 18 of the GDPR, including where the accuracy of personal data is contested, exercised upon a request submitted to the Controller;

5) data portability: The User has the right to obtain from the Controller personal data concerning the User in a structured, commonly used and machine-readable format, exercised upon a request submitted to the Controller;

6) object to the processing of personal data: The User has the right to object to the processing of their personal data in the cases specified in Article 21 of the GDPR, exercised upon a request submitted to the Controller;

7) lodge a complaint: The User has the right to lodge a complaint with the supervisory authority responsible for personal data protection.
